1. Eligibility

Age Requirements

• You must be at least 13 years old to use Sparrow
• If you are between 13 and 18 years old, you may only use Sparrow with the consent and supervision of a parent or legal guardian
• By using Sparrow, you represent that you meet these eligibility requirements

2. Description of Service

Sparrow is a personal budgeting application that helps you:

• Track income and expenses
• Organize money using envelope-style budgeting ("Nests")
• View your "Safe-to-Spend" balance
• Optionally sync bank transactions via SimpleFIN
• Optionally use AI-powered budget insights

The App stores your data locally on your device with optional iCloud synchronization.

3. Account Security

Your Responsibilities

• Keep your device secure with a passcode, Face ID, or Touch ID
• Keep your iCloud account credentials confidential
• Don't share your SimpleFIN access token with others
• Notify us immediately if you suspect unauthorized access

Our Responsibilities

• We don't store your data on our servers
• We don't have access to your bank login credentials
• We implement industry-standard security practices

4. Subscription & Billing

Free Features

Sparrow offers free features including basic budgeting, transaction tracking, bank sync, and CSV import.

Sparrow Premium

Premium features are available through in-app purchases:

Auto-Renewal Terms

• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period
• Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage and cancel subscriptions in your device's Settings > [Your Name] > Subscriptions

Free Trial

• If offered, free trials automatically convert to paid subscriptions unless cancelled before the trial ends
• Any unused portion of a free trial is forfeited when you purchase a subscription

Refunds

All purchases are processed by Apple and subject to Apple's refund policies. To request a refund, visit reportaproblem.apple.com.

5. Acceptable Use

You Agree To:

• Use Sparrow only for lawful, personal budgeting purposes
• Provide accurate information when using the App
• Comply with all applicable laws and regulations

You Agree NOT To:

• Use Sparrow for any illegal purpose
• Attempt to reverse engineer, decompile, or disassemble the App
• Attempt to gain unauthorized access to the App's systems
• Use automated systems to extract data from the App
• Distribute, license, or sell the App or any part of it
• Remove or alter any copyright or proprietary notices
• Introduce viruses, malware, or other harmful code

6. Financial Disclaimer

The App is a tool to help you organize and visualize your personal finances. It does not provide financial, tax, legal, investment, or professional advice of any kind.

Important Limitations

• Accuracy: The App may contain errors in calculations, data synchronization, or transaction categorization
• Bank Data: Transaction data from connected banks may be delayed, incomplete, or inaccurate
• Decisions: You are solely responsible for all financial decisions you make
• Not a Financial Institution: Sparrow is not a bank, broker, or financial advisor

Always consult with qualified financial, tax, or legal professionals for advice specific to your situation.

7. Third-Party Services

Sparrow integrates with optional third-party services:

SimpleFIN

• Provides bank account synchronization
• Governed by SimpleFIN's Terms of Service and Privacy Policy

AI Providers

• If you configure external AI services, your use is subject to that provider's terms
• On-device AI (Apple Intelligence) is governed by Apple's terms

Apple Services

• App Store purchases are subject to Apple's Terms of Service
• iCloud sync is subject to Apple's iCloud Terms

We are not responsible for the availability, accuracy, or practices of any third-party services.

8. Intellectual Property

Our Property

Sparrow and its original content, features, functionality, design, and branding are owned by us and protected by copyright, trademark, and other intellectual property laws.

Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to use Sparrow for your personal, non-commercial budgeting purposes.

Your Data

You retain ownership of the financial data you enter into Sparrow. We don't claim any ownership rights to your data.

9. User Data & Privacy

Your use of Sparrow is also governed by our Privacy Policy, which describes how we handle your information.

Key points:

• Your data is stored locally on your device
• We don't have servers storing your personal or financial data
• Optional iCloud sync stores data in your personal iCloud account
• We don't sell your data or use it for advertising

10. Disclaimers

To the maximum extent permitted by law, we disclaim all warranties, express or implied, including:

• Implied warranties of merchantability and fitness for a particular purpose
• Warranties that the App will be uninterrupted, error-free, or secure
• Warranties regarding the accuracy of any information obtained through the App
• Warranties regarding the accuracy of bank data from third-party services

Some jurisdictions don't allow disclaimer of implied warranties, so some of the above may not apply to you.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• We are not liable for any indirect, incidental, special, consequential, or punitive damages
• We are not liable for any loss of profits, data, use, goodwill, or other intangible losses
• Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim, or $50 USD, whichever is greater

Specific Exclusions

We are not liable for:

• Financial losses resulting from decisions made using the App
• Errors or inaccuracies in transaction data from connected banks
• Data loss or corruption on your device
• Interruptions in bank sync or iCloud services
• Actions or omissions of third-party service providers

Some jurisdictions don't allow limitation of liability, so some of the above may not apply to you.

12. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of Sparrow
• Your violation of these Terms
• Your violation of any third party's rights
• Any financial decisions you make based on information from the App

13. Modifications to Service & Terms

Service Changes

We may modify, suspend, or discontinue any part of Sparrow at any time without notice. We are not liable for any modification, suspension, or discontinuation of the service.

Terms Changes

We may update these Terms from time to time. When we make changes:

• We will update the "Last updated" date at the top
• For material changes, we may notify you through the App or App Store
• Continued use of Sparrow after changes constitutes acceptance

14. Termination

By You

You may stop using Sparrow at any time by deleting the App. Your data remains on your device unless you delete it.

By Us

We may terminate or suspend your access to Sparrow immediately, without notice, if:

• You breach these Terms
• We are required to do so by law
• We discontinue the App

15. Dispute Resolution

Informal Resolution

Before filing any formal dispute, you agree to contact us at support@sparrowbudgeting.app to attempt to resolve the dispute informally.

Governing Law

These Terms are governed by the laws of the United States and the State of California, without regard to conflict of law principles.

Jurisdiction

Any disputes that cannot be resolved informally shall be resolved in the state or federal courts located in California.

16. General Provisions

• Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and us
• Severability: If any provision is found unenforceable, the remaining provisions continue in effect
• Waiver: Our failure to enforce any right doesn't constitute a waiver of that right
• Assignment: You may not assign these Terms; we may assign our rights without restriction
